Same Judge OK'ed Muslim Prayer


The same San Francisco federal judge who just overturned a federal law banning partial-birth abortions also approved of Muslim prayer in schools when federal rulings ban all other denominational prayers and activities.


In a December 2003 decision, U.S. District Judge Phyllis Hamilton decided that it was lawful for a California middle school teacher to require students to recite Muslim prayers, get down on their knees and role-play as Muslim adherents.

As part of the class students were told to recite: "In the name of Allah, the Compassionate, the Merciful. Praise be to Allah, Lord of Creation, The Compassionate, the Merciful, King of Judgment-day! You alone we worship, and to You alone we pray for help, Guide us to the straight path."


The Byron County 7th-grade world history teacher was sued by the parents of one of the students, who claimed that their child had been coerced to engage in a religious practice.

Hamilton, in a summary judgment, ruled that the teacher's actions were legal.

The teacher prepared a student guide which said that as part of the study of Islam "you and your classmates will become Muslims."

According to court documents, the teacher also read the Koran and Muslim prayers out loud in class and required students to recite lines of Muslim prayers in class as well.

Students also were told to recite Islamic prayers as they exited the class, including the Muslim refrain "In the name of God, most merciful, most gracious."

The teacher also assigned students to fast or give up something like TV for a day to experience Islam's month of Ramadan and one of its pillars of faith.

At the end of their Islamic studies, students also were required to write an essay on Islam. But, but the teacher instructed her students, "BE CAREFUL HERE – If you don't have something positive to say, don't say anything!!!"

In her ruling, Judge Hamilton threw out the parents' case, saying the religious role-playing was not tantamount to the exercise of religion and the school activities were not of a devotional or religious nature.

What was the class? If it is a 'World Religions' class and they go through these motions for each religion, then there's no problem. If anything, this would eliminate much of the misunderstandings between religions, would it not? Or are Christians afraid that they will lose their congregation if people see what the options are?

I briefly studied Islam and other religions in school but didn't have to practice them in order to understand the basic tenets. Is it any wonder that public schools are the cesspool of human education?

Presenting options and mandating students to "be" Muslims are two different things. The teacher should at the very least be suspended without pay if not terminated. I don't think Christianity would receive a similar ruling from this kangaroo court. They can pray but it must be student led not teacher mandated.

Look there isn't a damn thing wrong with teaching students about other cultures and religions. Our young folk need to have and understanding and respect for others who aren't "just like them" as long as the material, potentially controversial, is approved by the school admin.

But, I agree with XP, seems a little overboard for a History class? If it were religious studies then I'd have no problem.

X...there is no evidence that I can see that was the case.

The outrage is that if a student a even attempts to prayer (christian)...the schools call in the national guard...with the student facing suspension...You can't even pray optionally.

Go figure this teacher does this with a captive audience...just like hostage taking training.

These parents that sued that dumbass teacher did so because of reasons I stated. If you have no objection or just no balls to stand up to me then by all means, worship me.

The course is World History and Geography and it appears that this is the only religion to be taught in this manner in this course based on what I can piece together from two other articles I've read. In which case, the methodology is narrow in its focus and culturally biased, something public schools aren't supposed to do.

You can almost set your clock by some people's reasoning on this forum. I'm gone 8 days on vacation and upon return I find people defending a teacher's commission of theological rape. Unbelievable!

My statement if you took the time to rationally understand dealt with teaching about different cultures. I said nothing about forced prayer, did I?
Once again, if it were a religious studies class, where there was a balance, and the curriculum was approved by the school admin, and the students were provided with a course outline (to share with their parents), then I would be supportive.

Read my post again, it was fairly general and was a statement of the obvious, if we teach intolerance of everyone different (as I suspect you'd enjoy) then how in the fuk are we to get along with the rest of the world, or even expect our kids to understand the world? Geez it's pretty fuking obvious that was not a statement about forcing anyone to pray!

Cussin there is nothing in that article that suggest that...do you think the parents would have sued if they knew that was part of the curriclum...if you had a 13 year old girl that signed up for sex education class...does that mean the teacher can play act with oral sex????

They were given a syllabus. Unfortuneately, the school board doesn't have time to micro-manage every little thing. That's why the teachers are given considerable leeway in their course contents.

So I don't misquote you, if this were a religious studies class, it would be Ok?

Remember rape is rape. Whether they have to get on their knees for God, Allah or Brahma it's still putting someone's academic standing on the line for what, tolerance?

You might not have mentioned your preferrance for forced prayer but given the tone of your message, it was implied. I, for one, don't care which religion is being taught and any teacher mandating it's exercise should be suspended and/or terminated.

BAR: This is an utter falsehood.

You cannot show me a cite of a student attempting to pray and facing suspension.

You may be able to show cites of a student attempting to 'lead a group prayer', or provide an invocation to a school event, but there is no restriction on students doing all the personal, private prayer they wish in American public schools.

As for the judges' rulings, I'm surprised by the school judgement, but would not be surprised to see it overturned if the parents elect to appeal to a higher court.

Her ruling on abortion rights, OTOH, should stand up just fine to possible appeals.

Win some, lose some.

Beats appointing judges who believe Jesus gives orders to the President.

I may not be able to provide sources, but I've heard of people being suspended for wearing religous shirts. Also, there was an Islamic girl suspended for wearing a hijab. People over-interpret the Constitution.

I think it's funny how I'm accused of not reading into your posts when I directly mentioned that I actually studied Islam, Hinduism, Buddhism and a whole host of other religions in grade school. Bear in mind that this was a Christian school. I also studied Darwinism and neo-Darwinism. They nor do I don't have a problem with information or intolerance as you would suggest.

I come across as a hateful guy at times but please don't say I'm right-wing biased. Between the two of us, I have witnessed first-hand the Islamic culture. When you spend 2 years or more there I'll give you the benefit of your wisdom but I have a sneaking suspicion you have never spent more than a month outside of the ozarks. You're the only one that knows.
